Privacy Policy
1. Scope
This Privacy Policy describes how GarageFind LLC ("GarageFind") collects, uses, discloses, and otherwise processes information in connection with the GarageFind website and related services (the "Services"). It is incorporated into the Terms of Use, and capitalized terms used but not defined here have the meanings given to them in the Terms of Use. By accessing or using the Services, you acknowledge the practices described in this Policy.
This Policy does not apply to the practices of third parties that GarageFind does not control, including Sellers, Buyers, payment processors, and other third-party services, even where accessed through the Services.
2. Information We Collect
GarageFind collects information in three ways: information you provide, information collected automatically, and information received from third parties.
2.1 Information you provide. This includes the information you submit when you create an account, complete your profile, create a listing, communicate with other Users or with GarageFind, open or respond to a claim, or otherwise use the Services -- including your name, email address, postal and shipping address, telephone number, listing content and images, and the contents of your communications.
2.2 Transaction and payment information. When you transact through GarageFind checkout, GarageFind receives transaction details such as the items purchased, amounts, and shipping information. Payment processing and identity verification are performed by Stripe, GarageFind's payment processor. GarageFind does not collect or store full payment card numbers or financial account credentials. Information you submit to Stripe is processed by Stripe under Stripe's own terms and privacy policy (Section 5).
2.3 Information collected automatically. When you use the Services, GarageFind and its service providers may collect device and usage information, including IP address, browser and device type, operating system, identifiers, pages and listings viewed, referring pages, and the dates and times of access, through cookies and similar technologies (Section 6).
2.4 Information from third parties. GarageFind may receive information from its service providers, including identity-verification, fraud-prevention, and analytics providers, and from Stripe in connection with seller onboarding and payments.
3. How We Use Information
GarageFind uses information to operate, provide, and improve the Services; to create and manage accounts; to facilitate listings, transactions, and the Purchase Protection program; to process payments through Stripe; to verify identity and prevent fraud; to communicate with you, including service and transactional messages; to personalize and develop the Services and to develop new products and services; to conduct research, analytics, and business operations; to enforce the Terms of Use and applicable policies; to comply with legal obligations, including tax and marketplace-facilitator obligations; and to protect the rights, property, and safety of GarageFind, its Users, and others.
Our rights to information. Subject to applicable law and the rights described in Section 7, GarageFind retains the right to use, retain, and process the information it collects for the purposes described in this Policy and for its legitimate business and commercial purposes. GarageFind may create, retain, use, and disclose de-identified and aggregated information -- information that does not identify and cannot reasonably be linked to a particular individual -- for any lawful purpose without restriction, including to operate, analyze, improve, and market the Services and to develop other products and services. GarageFind will maintain and use de-identified information in de-identified form and will not attempt to reidentify it except as permitted by law.
4. How We Share Information
GarageFind does not sell personal information for money. Certain uses of cookies and similar technologies for analytics or advertising may, however, constitute a "sale" or "sharing" of personal information under California law as those terms are broadly defined; where that is the case, you may exercise the opt-out described in Section 7. GarageFind discloses information as follows:
4.1 Service providers. GarageFind shares information with vendors that perform services on its behalf, including Stripe (payments and identity verification), hosting, communications, fraud-prevention, and analytics providers, which are permitted to use the information only to provide those services.
4.2 Other Users, to effect transactions. To complete a transaction, GarageFind shares the information reasonably necessary between Buyer and Seller, such as the shipping name and address and order details. You are responsible for your handling of any information you receive about another User, and you may use it only to complete and support the relevant transaction.
4.3 Legal and safety. GarageFind may disclose information where it believes disclosure is required by law or legal process, or is reasonably necessary to enforce its agreements, investigate suspected fraud or violations, or protect the rights, property, or safety of GarageFind, its Users, or others.
4.4 Business transfers. GarageFind may disclose or transfer information in connection with a merger, acquisition, financing, or sale of assets.
4.5 With your direction or consent. GarageFind may share information at your direction or with your consent.
GarageFind is not responsible for the practices of other Users or third parties with whom information is shared at your direction or in the course of a transaction.
5. Payments and Identity Verification
Payments and seller identity verification are provided by Stripe. When you provide personal data in connection with a payment or seller onboarding, Stripe receives and processes that data in accordance with Stripe's Privacy Policy, available at https://stripe.com/privacy. GarageFind's payment processor may obtain information from identity and credit reference agencies to verify your identity, and that information will be used for the purposes described in Stripe's Privacy Policy.
6. Cookies and Similar Technologies
GarageFind and its service providers use cookies and similar technologies to operate and secure the Services, remember preferences, and analyze usage. You can control cookies through your browser settings; disabling certain cookies may affect the functionality of the Services.
7. Your Choices and Rights
7.1 General choices. You may access and update your account information through your account settings, and you may request deletion of your account. You may opt out of non-transactional marketing communications through the unsubscribe mechanism in those messages; GarageFind may still send service and transactional messages.
7.2 California privacy rights (CCPA/CPRA). GarageFind treats the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA"), as applying to its handling of the personal information of California residents.
Categories of personal information. In the past 12 months, GarageFind may have collected the following categories of personal information, as defined by the CCPA: identifiers (such as name, email, postal address, telephone number, and IP address); customer records information (such as shipping and contact details); commercial information (such as transactions and listings); internet or other network activity (such as usage and device information); geolocation data (such as that derived from IP address); and inferences drawn from the foregoing. Sensitive personal information, including government identifiers and financial account information, is collected and processed by Stripe for identity verification and payments, and GarageFind does not collect or store full payment card numbers or financial account credentials.
Sources, purposes, and disclosures. The sources of personal information are described in Section 2, the purposes of use in Section 3, and the categories of recipients in Section 4. GarageFind discloses personal information to service providers, to other Users to effect transactions, for legal and safety purposes, and in business transfers.
Sale and sharing. GarageFind does not sell personal information for money. To the extent any use of cookies or similar technologies constitutes a "sale" or "sharing" of personal information for cross-context behavioral advertising under the CCPA, you may opt out as described below.
Use of sensitive personal information. GarageFind uses sensitive personal information only for purposes permitted under the CCPA, such as providing the Services, verifying identity, and preventing fraud, and not for the purpose of inferring characteristics about you. Accordingly, GarageFind does not offer a separate "limit" election; the right to limit is described below for completeness.
Your rights. Subject to verification and applicable exceptions, California residents may:
- request to know the categories and specific pieces of personal information collected, the sources, the purposes, and the categories of third parties to whom it was disclosed (right to know/access);
- request correction of inaccurate personal information (right to correct);
- request deletion of personal information (right to delete);
- opt out of any "sale" or "sharing" of personal information (right to opt out); and
- limit the use and disclosure of sensitive personal information to permitted purposes (right to limit).
California residents have the right not to receive discriminatory treatment for exercising these rights.
How to exercise your rights. You may submit a request through the Your Privacy Choices page or by emailing privacy@garage-find.com. GarageFind will verify your request using the information associated with your account and may request additional information reasonably necessary to verify your identity. An authorized agent may submit a request on your behalf with proof of authorization. GarageFind will respond within the timeframes required by the CCPA (generally within 45 days, extendable by an additional 45 days with notice).
Retained rights. Exercising the right to delete does not require GarageFind to delete information it is permitted or required to retain, including to complete a transaction, comply with legal, tax, or recordkeeping obligations, detect and prevent fraud and abuse, secure the Services, or for internal uses reasonably aligned with your expectations, and does not apply to de-identified or aggregated information.
8. Data Retention
GarageFind retains personal information for as long as necessary to provide the Services, comply with legal, tax, and recordkeeping obligations, resolve disputes, prevent fraud and abuse, and enforce its agreements. Retention periods vary by the type of information and the purpose for which it is held.
9. Security
GarageFind uses commercially reasonable measures designed to protect personal information. However, no method of transmission or storage is completely secure, and GarageFind cannot guarantee the absolute security of information. You are responsible for maintaining the confidentiality of your account credentials.
10. Children
The Services are not directed to, and may not be used by, anyone under 18 years of age. GarageFind does not knowingly collect personal information from anyone under 18. If GarageFind learns that it has collected such information, it will take reasonable steps to delete it.
11. Third-Party Links and Services
The Services may contain links to, or integrations with, third-party websites and services. GarageFind does not control and is not responsible for the privacy or security practices of those third parties. Information you provide to a third party is governed by that third party's policies, and your use of third-party services is at your own risk.
12. United States Processing
The Services are intended for use within the United States, and information is processed and stored in the United States.
13. Changes to This Policy
GarageFind may update this Policy. Material changes will be communicated with reasonable notice, and the "Last updated" date will reflect the most recent revision.
